Act III of this play concluded this morning-as Trump woke up and plugged Sekulow’s latest appearance on state-run media before having some second thoughts.
Beleaguered Attorney General Jeff Sessions, recused from the investigation into Russian meddling in the 2016 election and the firing of FBI Director James Comey, faced the lions before the Senate Intelligence Committee last week and survived with barely a scratch.
Deputy Attorney General Rod Rosenstein, who has oversight authority over the special counsel investigation, has told colleagues he may have to recuse himself, but he has not yet made a decision. Trump said previously that a memo from Rosenstein recommending the Federal Bureau of Investigation director’s termination didn’t matter.

Public perception aside, being the subject of an investigation is also debilitating because of the time it takes to defend oneself, the financial burden of retaining lawyers (and, for a public official, retaining press agents who can deal with the media frenzy), and the anxiety that makes it hard to focus on one’s job and other responsibilities.
Sekulow says that Trump hasn’t been notified of any investigation. The issue is whether Trump criminally obstructed justice.
Then, Sekulow continued, Trump took their recommendations to remove Comey, and “now according to The Washington Post’s theory, he’s under investigation for taking the action that the Department of Justice told him to take”.
“It’s possible we will have an answer to that at the end of the week”, Spicer said in an off-camera briefing.
Later in the interview, Cuomo asked Sekulow why Trump’s legal team had not directly asked Mueller whether the president was under investigation, suggesting that it was purposefully remaining ignorant on the question.

The details of how that online sampling is done are not clear. King said the “collusion, the cooperation aspect of the investigation is not over”. Mueller may yet look into the president’s behavior to see if any obstruction occurred, but he won’t open a criminal investigation unless he’s pretty damn sure of his grounds. He’s done this on several occasions. Only if they decide to file charges and go to court is evidence shown.
